The terms that govern your use of this website.
1. About This Site and These Terms
This website is operated by Thomas A. Jones, LCSW, LCADC, an individual practitioner licensed as a clinical social worker in Nevada (6182-C), Utah (14232258-3501), and Arizona (license number pending), and as a clinical alcohol and drug counselor in Nevada (00409-LC). In these Terms, "I," "me," and "my" refer to Thomas A. Jones. "You" means the person using the site.
The site exists to describe my therapy practice and to share general information about mental health. It is intended for adults (18 and older) in the United States.
2. Acceptance of Terms
By browsing the site, reading its content, sending the contact form, or following a booking link, you confirm that you have read these Terms and the Privacy Policy and agree to be bound by them.
3. Informational Content Only, Not Clinical Advice
Everything on this website, including pages, FAQs, resource links, and any blog posts, is general information. It is not medical advice, not mental-health advice, not therapy, not diagnosis, and not treatment, and it is no substitute for care from a licensed clinician who knows your history. Nothing here is tailored to you.
4. No Therapist-Client Relationship From Using This Site
Reading this site, emailing me, or sending the contact form does not make you my client and does not create a therapist-client relationship. That relationship begins only after all of the following have happened:
- You have completed and signed my informed consent and intake paperwork, including the fee agreement and acknowledgment of the Notice of Privacy Practices.
- I have confirmed you are eligible, including that you will be located in a state where I am licensed during each session (Section 6).
- You have attended a first scheduled session.
Until then, anything you send through this website, by email, or by phone is a prospective inquiry only.
5. Not for Emergencies
This website does not provide emergency services. The contact form, email, and voicemail are not monitored for emergencies. If you or someone you know is in crisis or in danger:
- Call or text 988 (Suicide and Crisis Lifeline), available 24 hours a day.
- Call 911 or go to the nearest emergency room.
6. Where Sessions Are Offered
Intake paperwork asks you to confirm your address and your location at session time. Providing false location information may result in termination of services.
7. Contact Form and Email
Messages sent through the contact form are processed by a third-party service (FormSubmit) and delivered to a standard Gmail inbox. Neither the form nor email is a secure channel for health information, and neither meets HIPAA's requirements for protected health information.
Do not send diagnoses, medications, detailed clinical history, or other sensitive material through the form or by unencrypted email. Save it for your first session, where communication is protected. By checking the acknowledgment box on the form, you confirm you understand this.
I will try to answer every inquiry, but receiving one does not guarantee availability, acceptance as a client, or a fit with your insurance.
8. External Links and Third-Party Sites
This site links to outside websites, including my booking page on Alma, my Psychology Today profiles, and the organizations listed on the Resources page. These links are provided for convenience. I do not control those sites and am not responsible for their content, accuracy, privacy practices, or availability. Your use of them is governed by their own terms. A link does not imply affiliation, sponsorship, or endorsement.
9. Intellectual Property
Unless otherwise noted, the content of this website, including text, images, page layouts, and source code, belongs to Thomas A. Jones or his licensors and is protected by copyright and other intellectual-property laws.
You may view, print, and download a reasonable number of pages for your own personal, non-commercial use.
You may not copy, republish, scrape, mirror, sell, modify, or create derivative works from any part of the site; remove copyright notices; use my name or likeness in advertising; or use the content to train machine-learning models, without my prior written permission.
Content from other sources that appears on or is linked from this site remains the property of its owners.
10. Testimonials and User Content
This site does not publish client testimonials or reviews, in keeping with the ethics rules that apply to licensed clinical social workers. If you submit content to me (for example, in a message), you confirm it is your own and grant me permission to use it for the purpose you sent it.
11. Acceptable Use
You agree not to:
- Use the site for any unlawful purpose.
- Attempt to gain unauthorized access to the site, its hosting, or any related system.
- Interfere with, probe, or scrape the site in ways that impair its operation or security.
- Submit false, misleading, or impersonating information through the contact form or by email.
- Transmit malware or other harmful code.
- Use automated tools beyond ordinary search-engine and answer-engine indexing without my written permission.
- Frame, mirror, or embed the site within another site without my written permission.
12. Disclaimer of Warranties
The website and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. I do not warrant that the site will be error-free, secure, or continuously available, or that its information is complete or current. Any reliance you place on it is at your own risk.
13. Limitation of Liability
To the fullest extent permitted by law, I am not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, goodwill, or other intangible loss, arising out of or related to:
- Your use of, or inability to use, the site;
- Any content on the site, including errors or omissions;
- Any third-party site or service linked from the site;
- Any unauthorized access to or alteration of your transmissions.
This applies whatever the legal theory and whether or not I was advised that such damages were possible. My total liability for all claims related to this free informational website is limited to one hundred U.S. dollars ($100).
Some jurisdictions do not allow certain exclusions or limits. In those places the above applies to the maximum extent the law permits. Nothing in these Terms limits any right you have as a prospective or current client under the licensing laws of the states where I practice, or under HIPAA.
14. Indemnification
You agree to indemnify and hold me harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from your use of the site, your violation of these Terms, your violation of any law or third-party right, or any content you submit.
15. Governing Law
These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of the site will be brought in a court of competent jurisdiction in Nevada, and you consent to that jurisdiction.
16. Severability and No Waiver
If any part of these Terms is found unenforceable, the rest remains in effect. My not enforcing a provision on one occasion is not a waiver of it on another.
17. Changes to These Terms
I may update these Terms from time to time. When I do, the "Last reviewed" date and version number at the top of this page will change. Your continued use of the site after an update means you accept the revised Terms.
